This Privacy Policy describes how Artificial Analysis, Inc. ("Company," "we," "us," or "our") collects, uses, discloses, and otherwise processes information about you when you access or use Image Lab, our online AI image generation and comparison service (the "Service"), available at artificialanalysis.ai/image/image-lab and through such other interfaces as we may provide, and when you otherwise interact with us, such as through our customer support channels.

Our primary business offering through the Service is an AI-powered image generation and comparison platform that enables users to generate images using third-party AI models and compare results side-by-side. We also operate an independent AI benchmarking and insights business. This Privacy Policy applies to the processing of personal information in connection with the Service.

This Privacy Policy is incorporated into and forms part of our Terms of Service. Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. If we make material changes, we will provide you with additional notice (such as by sending you a notification or adding a statement to the Service). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

1. Collection of Information

The information we collect about you depends on how you use our Service or otherwise interact with us. In this section, we describe the categories of information we collect and the sources of this information.

1.1 Information You Provide to Us

We collect information you provide directly to us. For example, we collect information directly from you when you create an account, purchase credits, submit Input to generate images, provide Feedback, request customer support, or otherwise communicate with us. The types of information we collect directly from you include:

Account Information: your name, email address, and authentication credentials (including information from Third-Party Accounts such as GitHub or Google, as described in the Terms).

Payment Information: if you make a purchase, we work with a third-party payment processor to process your payment information. We receive your name, last four digits of your payment method, billing address, and transaction details. We do not store full credit card numbers.

Your Content: the Input you submit to the Service (including prompts, parameters, and settings) and the Output generated through the Service (including AI-generated images). As described in the Terms, Input and Output are collectively referred to as "Your Content."

Communications: any information you provide when you contact us for support, submit Feedback, or otherwise communicate with us, including the content of your messages and any attachments.

1.2 Information We Collect Automatically

We automatically collect information about your interactions with us and our Service, including:

Transactional Information: when you purchase credits or use the Service, we collect information about the transaction, including credit balance changes, the AI Services selected, the number and type of image generation requests, and the date and time of each transaction.

Device, Usage, and Activity Information: we collect information about how you access our Service, including data about the device and network you use, such as your hardware model, operating system version, IP address, unique device identifiers, and browser type. We also collect information about your activity on our Service, such as pages viewed, features used, access dates and times, and interaction patterns.

Information Collected by Cookies and Similar Tracking Technologies: we use tracking technologies, such as cookies, pixels, and similar technologies to collect information about your interactions with the Service and our marketing communications. These technologies help us improve our Service and marketing communications, personalize your experience, and analyze your interactions with us. For more information, see the Targeted Advertising and Analytics and Your Choices sections below.

1.3 Information We Collect from Other Sources

We obtain information from other sources. For example, we collect information from our payment processor (including your name, partial payment details, billing address, and IP address) and from third-party authentication providers when you create or log into your account through a third-party platform (such as GitHub or Google). When you authenticate through a third-party platform, we may receive your name, email address, account identifier, and any other information the platform discloses about you in accordance with its authorization procedures.

1.4 Information We Derive

We may derive information or draw inferences about you based on the information we collect. For example, we may infer your approximate location based on your IP address, or we may derive usage patterns from your interaction with the Service to improve our analytics and benchmarking products.

2. Use of Information

We use the information we collect to provide, maintain, and improve the Service. We also use the information we collect to:

Provide the Service: process your image generation requests by transmitting your Input to third-party AI Service providers and delivering the resulting Output to you; manage your account and credit balance; and process transactions.

Improve and Develop: monitor and analyze trends, usage, and activities in connection with the Service; maintain, debug, and improve the Service; and design, develop, and offer new Company products, services, AI models, and benchmarks.

Generate Analytics and Benchmarking Data: generate anonymized and aggregated analytics, benchmarks, insights, indices, rankings, and other data products relating to the performance, quality, and capabilities of AI Services ("Benchmarking Data"), as described in Section 4 below.

Communicate with You: send you technical notices, security alerts, support messages, and other transactional or relationship messages; and send you marketing communications (see the Your Choices section for information about how to opt out).

Protect and Secure: detect, investigate, respond to, and help protect against security incidents, fraud, and other malicious, deceptive, or illegal activity, and help protect the rights and property of Company and others.

Legal Compliance: comply with our legal and financial obligations, respond to valid legal process, and enforce our Terms.

3. Sharing of Your Content with AI Service Providers

The Service operates by transmitting your Input to third-party AI image generation providers ("AI Service providers") and delivering the resulting Output back to you. This section describes how your Content is handled in that process.

3.1 Operational Sharing

When you submit Input through the Service, we transmit your Input to one or more AI Service providers to process your image generation request and deliver the resulting Output. This transmission is necessary to provide the Service and cannot be opted out of while using the Service.

3.2 AI Service Provider Data Practices

Once your Input has been transmitted to an AI Service provider, that provider may process and retain your Input in accordance with its own terms of service and privacy policy, which may include the right to use your Input for purposes beyond fulfilling your request, such as service improvement or model training. We have no control over and are not responsible for the data processing or retention practices of any AI Service provider, and we cannot guarantee the deletion, modification, or retrieval of your Input from any AI Service provider's systems.

We encourage you to review the privacy policies and terms of service of the AI Service providers accessible through the Service.

4. Data Sharing, Benchmarking, and Analytics

In addition to the operational sharing described in Section 3, we use and share Your Content and derived data as follows:

4.1 Anonymized and Aggregated Use

We use Your Content in anonymized and aggregated form (such that individual users are not personally identifiable) to generate Benchmarking Data; incorporate such Benchmarking Data into our products and services, including data products made available to our commercial customers; publish research, reports, and analysis; design, develop, and offer Company products, services, and AI models; and for any other lawful purposes. This use does not require your consent beyond acceptance of the Terms, and cannot be opted out of.

4.2 Identifiable Data Sharing with Third Parties

We may share Your Content in identifiable form (i.e., without anonymization or aggregation), including Input and associated metadata, with third parties pursuant to separate data sharing, partnership, research, or commercial agreements. These third parties may use Your Content to evaluate, improve, develop, benchmark, or train their products, services, or AI models, or for other lawful commercial or research purposes.

We require any third party receiving Your Content in identifiable form to be bound by confidentiality obligations and use restrictions with respect to such data.

We will not use your Input or Output in individually identifiable form for our own marketing or promotional purposes without your prior written consent.

4.3 Opt-Out of Identifiable Data Sharing

You may opt out of the identifiable data sharing described in Section 4.2 by emailing support@artificialanalysis.ai with the subject line "Opt Out of Data Sharing." Upon receipt of a valid opt-out request, we will cease sharing Your Content in identifiable form with third parties under Section 4.2 within thirty (30) days.

Opting out does not affect: (a) the operational sharing of your Input with AI Service providers as described in Section 3 (which is necessary to provide the Service); (b) our use of Your Content in anonymized and aggregated form as described in Section 4.1; or (c) data previously shared prior to the effective date of your opt-out.

4.4 Usage Data

We generate, collect, and process anonymized or aggregated data derived from the use of the Service, including data relating to the volume, frequency, type, and parameters of image generation requests; the AI Services selected or compared; user interaction patterns; quality assessments; and system performance metrics ("Usage Data"). Usage Data may be derived from Your Content but does not include Your Content in individually identifiable form.

We may use, transfer, and disclose Usage Data and Benchmarking Data to third parties, including our commercial customers and partners, for any lawful purpose, including to perform analytics, generate insights, publish research and reports, and design, develop, and offer Company products, services, and AI models. Our rights in Usage Data and Benchmarking Data survive any termination of the Terms.

5. Targeted Advertising and Analytics

We may engage others to provide analytics services, serve advertisements, and perform related services. To do this, we and these partners may use cookies, web beacons, pixels, device identifiers, and other technologies to collect information about your use of our Service and other websites and mobile apps, including your IP address, web browser and mobile network information, pages viewed, time spent on pages, links clicked, and conversion information. This information may be used to deliver advertising targeted to you on other companies' sites or apps, understand the effectiveness of this advertising, analyze and track data, and determine the popularity of certain content.

You can usually adjust your browser settings to remove or reject browser cookies. You may also learn more about interest-based ads, or opt out of having your web browsing information used for behavioral advertising purposes by companies that participate in the Digital Advertising Alliance, by visiting www.aboutads.info/choices.

6. Disclosure of Information

We disclose personal information as described in Sections 3, 4, and 5 above and in the following circumstances:

Vendors and Service Providers. We make personal information available to our vendors, service providers, contractors, and consultants who perform services on our behalf, such as companies that assist us with web hosting, cloud infrastructure, payment processing, fraud prevention and security, customer service, analytics, and marketing.

AI Service Providers. We share your Input with third-party AI Service providers as necessary to process your image generation requests and deliver Output, as described in Section 3.

Data Sharing Partners. We share Your Content with third parties under data sharing, partnership, research, or commercial agreements, as described in Section 4.2, subject to confidentiality obligations. You may opt out of identifiable data sharing as described in Section 4.3.

Commercial Customers. We make Benchmarking Data and Usage Data available to our commercial customers, partners, and the public as part of our benchmarking and analytics products and services.

Law Enforcement and Legal Proceedings. We disclose personal information in response to a request for information if we believe that disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.

To Protect Rights. We may disclose personal information if we believe that your actions are inconsistent with our Terms or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Company, our users, the public, or others.

Professional Advisors. We disclose personal information to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.

Corporate Transactions. We disclose personal information in connection with, or during negotiations of, certain corporate transactions, including a merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

With Your Consent and at Your Direction. We make personal information available to third parties when we have your consent or you intentionally direct us to do so.

We also disclose aggregated or de-identified information that cannot reasonably be used to identify you. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

7. Data Retention

We retain Your Content (including Input and Output) and associated metadata for as long as reasonably necessary to:

(a) operate and improve the Service;

(b) generate Benchmarking Data and Usage Data;

(c) fulfill our obligations under data sharing agreements with third parties as described in Section 4.2;

(d) comply with legal obligations;

(e) resolve disputes; and

(f) enforce our Terms.

We retain account information (such as your name, email address, and transaction history) for as long as your account is active and for a reasonable period thereafter to comply with legal obligations, resolve disputes, and enforce our Terms.

We retain Usage Data and Benchmarking Data indefinitely, as this data is anonymized and aggregated and is not subject to deletion requests.

We retain personal data collected through cookies and similar technologies in accordance with the retention periods specified for each technology and the practices of our analytics and advertising partners.

8. Data Deletion

You may request deletion of Your Content by sending an email to support@artificialanalysis.ai with the subject line "Request to Delete Data" and including the following information: (i) the name and email address associated with your account; (ii) a description of the specific Content you wish to have deleted (or a request for deletion of all Your Content); and (iii) any additional information reasonably necessary for us to identify and locate the relevant Content.

Upon receipt of a valid deletion request, we will use commercially reasonable efforts to delete or de-identify the specified Content from our active systems within thirty (30) days. You acknowledge and agree that:

(a) deletion does not extend to Usage Data or Benchmarking Data that has already been generated from Your Content in anonymized and aggregated form;

(b) deletion does not extend to Your Content that has been transmitted to third-party AI Service providers or shared with third parties pursuant to Section 4.2, as we do not control the retention practices of such parties;

(c) residual copies of Your Content may persist in backup systems for a limited period following deletion from active systems, subject to our standard backup retention schedules; and

(d) we may retain Your Content to the extent required by applicable law, regulation, or valid legal process, or as reasonably necessary to protect our legitimate legal interests.

9. Your Choices

9.1 Account Information

You can access, correct, and delete certain information stored within your account at any time by logging in and navigating to your account settings. You may also contact us at support@artificialanalysis.ai to make certain updates to your account information.

9.2 Opt-Out of Identifiable Data Sharing

You may opt out of identifiable data sharing as described in Section 4.3 by emailing support@artificialanalysis.ai with the subject line "Opt Out of Data Sharing." This does not affect operational sharing with AI Service providers (Section 3) or our use of anonymized and aggregated data (Section 4.1).

9.3 Cookies and Similar Tracking Technologies

You can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect some of the functionality of our Service. We choose the most privacy-preserving option when presenting cookie consent mechanisms, unless you instruct otherwise.

9.4 Communications Preferences

You may opt out of receiving promotional emails from us by following the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about your account, transactions, or our ongoing business relationship.

10. Security

We take reasonable measures to help protect personal information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or method of electronic storage is fully secure, and we cannot guarantee the absolute security of your information.

11. Children's Privacy

The Service is not intended for, and we do not knowingly collect personal information from, individuals under the age of 18. If we learn that we have collected personal information from someone under 18, we will take steps to delete such information. If you are a parent or guardian and you believe that your child under the age of 18 has provided us with personal information, please contact us at support@artificialanalysis.ai.

12. Additional Information for Individuals in Europe

If you are located in the European Economic Area ("EEA"), the United Kingdom ("UK"), or Switzerland, the following additional information applies to you.

12.1 Legal Basis for Processing

When we process your personal data, we do so in reliance on the following lawful bases:

Performance of Contract: to perform our obligations under our contract with you, including processing your image generation requests, managing your account and credits, and delivering Output (GDPR Article 6(1)(b)).

Legitimate Interests: when we have a legitimate interest in processing your personal data to operate our business or protect our interests, including to maintain and improve the Service, generate anonymized Benchmarking Data and Usage Data, conduct analytics, detect fraud and security incidents, and communicate with you. Our legitimate interests include operating and improving our benchmarking and analytics business, which relies on aggregated data derived from Service usage (GDPR Article 6(1)(f)).

Consent: when you have provided your consent, such as for the identifiable data sharing described in Section 4.2 (to the extent consent is required under applicable law), and for receiving marketing communications. When consent is the legal basis for our processing, you may withdraw it at any time (GDPR Article 6(1)(a)).

Legal Obligation: to comply with our legal obligations, such as maintaining records and responding to lawful requests (GDPR Article 6(1)(c)).

12.2 Data Subject Rights

Subject to applicable law, you have the right to:

(a) access your personal data, including in a portable format;

(b) request erasure of your personal data;

(c) request correction of inaccurate personal data;

(d) object to certain processing of your personal data;

(e) request that we restrict certain processing of your personal data; and

(f) withdraw consent where consent is the basis for processing.

12.3 Note on Identifiable Data Sharing

To the extent that the identifiable data sharing described in Section 4.2 involves your personal data, we rely on your consent as the legal basis for such sharing. You may withdraw your consent at any time by exercising the opt-out described in Section 4.3. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

If you are located in Australia, the following additional information applies to you.

We handle your personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). You have the right to request access to your personal information and to request that we correct any inaccurate information. 14. International Data Transfers

Artificial Analysis, Inc. is based in the United States, and we and our service providers process and store personal information on servers located in the United States and other countries. If you are located outside the United States, your personal information may be transferred to, processed in, and stored in the United States or other jurisdictions where our service providers and AI Service providers operate.

Whenever we make restricted international transfers of personal information, we take steps to ensure that your personal information receives an adequate level of protection by putting in place appropriate safeguards, such as standard contractual clauses approved by the European Commission or other recognized mechanisms, or we ensure that we can rely on an appropriate derogation under applicable data protection laws. Where relevant, you may request access to any safeguards which we use to transfer your personal information outside of the EEA, UK, or Switzerland (although we may need to redact data transfer agreements for reasons of commercial confidentiality).
